Terms and Conditions of Membership
By enrolling your child at True Talent Theatre School, you accept these terms and conditions ("Terms & Conditions") and sign your agreement to them as an ongoing agreement between you and True Talent Theatre School ("Agreement").
The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled student ("Student") by a Parent and True Talent Theatre School ("True Talent", "we", "our", "us") and is valid at all times whilst the Student is enrolled on any True Talent activity and until such time as written notice is given in accordance with these Terms & Conditions.
1 INTRODUCTION
1.1) These Terms & Conditions apply to all our true Talent schools, Courses, Holiday Workshops/Camps/Summer Schools and any additional products and/or services offered by True Talent Theatre School in the future for any Student (collectively "True Talent Activities").
1.2) For participation of a Student in a True Talent Activity all Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic application form online. We may update these Terms & Conditions from time to time.
1.3)Any changes to these Terms & Conditions require the written consent or approval of True Talent Theatre School.
1.4) A "Course" refers to a course of classes offering tuition in dance, drama, and singing which will be delivered during the Term (including online activities). Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.
1.5) "Workshop/Holiday Camp/Summer School" refer to workshops (including online activities) run by True Talent throughout the year. These offer tuition in dance, drama, singing and/or other performing arts related activities which will be delivered for a certain number of hours per day over a certain number of days. (These opportunities vary so please check with your Principal to see what’s available).
1.6) "Principal" refers to the principal of a particular True Talent school.
1.7) "Term" refers to one normal academic term of True Talent schools during which Courses are run.
1.8) "Term Dates" refers to the dates for the relevant Term. These will be provided through Coacha (our online member portal). Parents are required to sign up to Coacha upon enrolment.
1.9) “Online activity” refers to online streamed lessons and online Workshops utilising the Zoom platform delivered by True Talent.
1.10) “Subscriptions” refer to Course fees and are payable monthly by Direct Debit through the Coacha platform on the first (1st) of each calendar month. The Subscriptions consist of four (4) weekly sessions of tuition.
1.11) Courses break for one (1) week at Easter, four (4) weeks in summer and two (2) weeks at Christmas. (See 2.9 for Term Dates). Subscriptions continue through these breaks and are compensated by the five (5) session weeks that take place in a calendar month throughout the academic year. Subscriptions are paused by Coacha in August with no payment taken.
2 ENROLLING A NEW STUDENT IN A TRUE TALENT ACTIVITY
2.1) To apply for a place for a new Student on a True Talent Activity, the Parent must agree to these Terms & Conditions and submit an online application form.
2.2) Each Student's place is allocated on a 'first come, first served' basis.
2.3) Applications for Workshops must be accompanied by the appropriate “Deposit”. These Deposits vary so please check with the Principal for the requested activity.
2.4) From the date the Deposit is paid, you have a fourteen (14) calendar day cancellation period ("Cancellation Period") to change your mind and cancel the Student's place on the Workshop, subject to clauses 2.4 and 2.5 below.
2.5) After the Cancellation Period expires, the Deposit is non-refundable and will be retained by True Talent.
2.6) If the start date of a True Talent Activity falls within the Cancellation Period and the True Talent Workshop has finished before the Parent notifies True Talent of their desire to cancel, then the Deposit is not cancellable or refundable.
2.7) If the start date of the True Talent Workshop falls within the Cancellation Period and some of the sessions of the true Talent Activity have been delivered before the Parent, within the Cancellation Period, notifies True Talent of their desire to cancel, then the Deposit may be partly refunded in proportion to the number of sessions delivered.
2.8) Times, current Term Dates, fees and all relevant course details for booked True Talent Workshop will be confirmed in the Acceptance Letter or "Fee Note" for each True Talent Activity, along with a receipt for payment of the Deposit.
2.9) All such terms and conditions detailed in the Fee Note or the Acceptance shall be incorporated into the Agreement and shall be deemed to have been accepted by the Parent upon payment by, or on behalf of, the Parent.
2.10) Fees for true Talent Activities may vary between true Talent schools.
3 BALANCE PAYMENTS
3.1) For a Student enrolled on a Workshop, the full fees are paid as the Deposit in advance, as detailed above.
3.2) For a Student enrolled on a Workshop, following payment of the Deposit to true Talent, Parents are required to make a subsequent payment of the outstanding balance due to true Talent (the "Balance").
3.3) The Balance must be paid in full, subject to any alternative agreements made with the Principal, by the first day of the Workshop by Bank Transfer or cash.
4 COURSES
4.1) Once enrolled on a Course, Term Dates for the next Term will be made known to Parents through the Coacha platform at the end of the current Term.
4.2) Payment is due for the monthly Course Subscription on the first (1st) day of the calendar month in advance of the tuition.
4.3) If you wish to cancel your Course Subscription, you must do so in writing thirty (30) days prior to the next scheduled payment date.
4.4) If less than thirty (30) days cancellation notice is given, you are liable for the next scheduled Subscription payment, regardless of attendance of the student.
5 COURSE TRIAL PERIODS
5.1) Where a new Student is attending a Course for the first time, subject to availability, True Talent allows a two (2) session trial period ("Trial Period") so that the Student may try two (2) sessions of a Course. The Trial Period only applies to Courses for new Students and the two (2) trial sessions must be taken consecutively within the Term. Payment can be made by cash or bank transfer.
5.2) At the end of the Trial Period, if you wish to continue, a Direct Debit must be set up for the first (1st) day of the next consecutive calendar month with the payment provider GoCardless. An account must also be registered with Coacha. These services manage your Subscription and any additional payments you may wish to make for uniforms, workshops etc. Both GoCardless and Coacha are free to use with excellent security features and are fully GDPR compliant.
5.3) Should your Trial Period end one (1) or two (2) weeks before the first (1st) of the next calendar month, the remaining Course sessions of that calendar month can be paid for by cash or bank transfer until the Direct Debit for the Course Subscription is in place.
5.4) If a Subscription by Direct Debit is not undertaken with True Talent, the Student may no longer attend the Course.
6 USE OF PERSONAL DATA
6.1) The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be processed by True Talent in accordance with its Privacy Policy, which can be found here Privacy Policy. A hard copy of the Privacy Policy can be requested from truetalenttheatre@gmail.com.
6.2) True Talent owns all the rights, title, and interest in and to its website, including text and media and its logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Course/Holiday Workshop/Summer School is owned by True Talent Theatre School.
7 HEALTH AND SAFETY
7.1) Students participate at their own risk and are obliged to inform True Talent and its staff of any existing injuries or medical conditions. All application forms must have any known medical conditions stated and any changes to such information must be notified to True Talent immediately in writing.
7.2) If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student on a True Talent Activity.
7.3) Any medication left on the school premises must be clearly labelled and the Student should, unless True Talent has agreed in writing otherwise, be able to administer it themselves.
7.4) Students must wear suitable footwear and clothing at all times for all Courses.
7.5) If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided on their sign up form. This number must always be contactable whilst the Student is attending the True Talent Activity.
7.6) Parents are solely responsible for ensuring that the emergency contact details with True Talent are up to date.
8 PERSONAL PROPERTY
8.1) Students are obliged to take care of their own belongings. True Talent can accept no liability for lost or damaged belongings.
8.2) You acknowledge that the maximum aggregate liability of True Talent to a Student or Parent under these Terms & Conditions shall not exceed the True Talent Activity fee to which a claim relates.
8.3) The liability of True Talent and that of its staff is restricted to class time only and then only to gross negligence.
9 GENERAL
9.1) True Talent may, at its own discretion, refuse a Student entry to a True Talent Activity if it is felt that the Student's behaviour is unacceptable.
9.2) True Talent reserves the right to make changes to the timetable, the teaching staff, the advertised programme, or the programme delivery mechanism (for clarity this may mean that we switch to online Zoom classes) in the event of illness or other circumstances beyond our control.
9.3) Where a session of a True Talent Activity has to be cancelled by True Talent, Principals will give as much notice as possible. In the event of a last-minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated True Talent social media site. Parents must ensure that they provide up-to-date contact in the Student’s Coacha profile.
In the event of a true Talent Activity being cancelled, True Talent will provide substitute lessons where possible either at an alternative time, venue or online. If no alternative can be offered, True Talent will provide refunds for lessons that are unable to be fulfilled.
9.4) It is occasionally necessary to change the time and/or venue of a True Talent Activity session. This will only be done if absolutely necessary and True Talent will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.
9.5) In the event that a Student is unable to attend a True Talent Activity session, due to sickness, holiday or a decision by the Parent or Student not to attend, True Talent regrets that it is unable to refund any payment.
9.6) All Students must be collected on time after a session where they do not have permission to leave unaccompanied. True Talent is unable to supervise Students after a session and consistent late collection will result in additional charges.
9.7) True Talent Activity fees are reviewed annually and may be increased each year.
9.8) These Terms & Conditions, together with any Fee Note or Acceptance Letter, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
9.9) In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
9.10) The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
